I can tell you a lot more after hearing the 11PM news. The accident happened at this crossing at New Courtland St. As the article says, the train didn't stop until it reached Pine st - two crossings later. According to a witness, the couple in the car had just eaten at the Burger King right by the crossing. He said it appears that the guy driving tried to beat the train. His wife, who was the passenger, has been confirmed dead. The driver's condition is not known at this time. The witness is in a state of shock over the accident.

Right now, it looks like the sun blinded the driver, preventing him from seeing the activated crossing, but lawers are not so sure about that citing investigation flaws and the fact that the crossing has had numerous problems in the past, including gates lowering with no flashing lights. The video includes a clip of the crossing activating. Now, Cohoes crossings are NOT in the best of shape (just look at Streetview). When I drove by the crossing before that street (Ontario), when the gates went down, I heard no bells ringing, despite the fact that there's two at the crossing.

Personally, I think the lawyer's kinda full of BS - he's making a mess out of nothing. The crossing malfunction COULD be true, but if everything's on tape, I don't think there's much to be missed. Plus, he also claims that the tree limbs prevented him from seeing the lights. You go to Streetview and yes, the right mast is covered somewhat, but the rest of the light sets are clearly visible, AND while the lights on the masts are 8", the lights on the cantilevers are 12".

But, now we know the age of the driver that drove through the crossing: 77. Anyone else seeing any red flags?
