Trespasser sues BNSF Railway

Published: Tuesday, November 17, 2009

JACKSON, Miss. — A woman who was hit by a train while standing on an active railroad line taking a picture has sued BNSF Railway for $6 million, the Associated Press has reported. Helen Gable, who nearly lost a leg in the incident, said the railroad was liable because it failed to post "no trespassing" signs.

BNSF spokeswoman Suann Lundsberg said the railroad is investigating, but noted, "she admits in her lawsuit filing that she was trespassing" while taking photos.

If they decide not to go ballistic on her, it's likely BNSF will settle out-of-court for about 50% of what they figure their legal fees would be. I'm sure that lady hopes for that.

That is crazy... but does not surprise me in this sue-happy world we live in now. Nobody anymore is willing to man-up and just say they made a stupid mistake.

Kind of like the lady that sued McDonald's awhile back when she spilled hot coffee in her lap. Sheesh!

Tracks + people standing on them = trespassing and hood ornament for next train.

What an idiot! She should have been a Darwin Award winner. Guess what, honey...you play with fire, you're gonna get burned; just like if you stand on the tracks long enough, you'll get hit by a :Censored: train!
You think your car gets bad mileage? SP 4449 consumes 10 gallons of bunker oil and 100 gallons of water every mile.

I speak my mind, if you don't like that oh well. I'll have you fill out a hurt feelings report and submit that to my office.
