I don't know if it is different in other states... but here in Illinois the traffic count and the number of accidents at the crossing have a factor in whether or not a crossing is approved to have gates.

In the long run... it all comes down to drivers being responsible. His comment about the people crossing the tracks and not seeing the lights... that would be their own fault, not the city's or the railroad's.

It's extremely rare for any new installations here in Iowa to be gateless.

The 2011 page is the only one showing an approved new installation of gateless signals.
Although this is only for those seeking financial assistance on a upgrade.

Well, at about 1:20 PM a southbound Norfolk Southern/BNSF mixed freight was going through the Quietdale Dr. crossing. The lights lit up on the signals but did not flash and I have reported it to Norfolk Southern.

I turns out that the WCH mechanical bells at Quietdale Dr. and Church st. replaced Safetran mechanical bells.
Church St.'s Safetran in a 1989 picture of the Huntsville Depot:
